Please read these Terms of Service (“Terms”) carefully before using HWTA (Health and Wellness Tracker Aid) (the “App”), developed and published by Ridge Road Apps LLC (“Ridge Road Apps,” “we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Not a medical device

HWTA is a personal wellness and symptom tracking tool. It is not a medical device. HWTA does not diagnose, treat, cure, or prevent any disease or medical condition, and does not provide medical advice of any kind.

Any patterns, correlations, summaries, or comparisons shown by the App are based solely on the information you have chosen to enter or that has been imported from a connected wearable device, and are provided for your personal reference only. They are not clinical interpretations and should not be treated as such.

Always consult a qualified healthcare provider for medical concerns, decisions, diagnosis, and treatment. Do not delay seeking medical care based on anything shown in this App. In an emergency, contact emergency services or a healthcare provider immediately — do not rely on this App.

2. Photos

If you choose to attach photos to your logs, you acknowledge that HWTA does not analyze, interpret, diagnose, or offer any medical opinion regarding the content of any photo. Photos are provided as a personal documentation tool only, intended to help you and, if you choose, a healthcare provider you share them with directly.

3. Accuracy of information

HWTA relies on information you enter yourself and, optionally, data provided by third-party wearable devices and platforms (such as Google Health Connect). We make no warranty as to the accuracy, completeness, or reliability of:

  • Information you enter
  • Data imported from connected wearables (which is estimated by the wearable device and its manufacturer, not verified by us)
  • Any pattern, correlation, or summary the App generates from this data

4. Eligibility

You must be at least 13 years old (or the relevant minimum age in your jurisdiction) to use HWTA. By using the App, you represent that you meet this requirement.

5. Your data

HWTA is designed to store your health information locally on your device. You are responsible for:

  • Maintaining the security of your device, including any PIN, biometric, or password protection you enable within the App
  • Managing and securing any encrypted backup files you create
  • Any consequences of losing access to your device or backup files, including loss of your health data, if you have not created or retained a backup

Ridge Road Apps does not have access to your locally stored data and cannot recover it on your behalf if it is lost.

6. HWTA Plus subscription

HWTA offers an optional subscription, HWTA Plus, which unlocks additional features described within the App. By purchasing HWTA Plus, you agree to the following:

  • Billing. Subscriptions are billed through Google Play Billing on a recurring basis (monthly or annual, as selected) until cancelled. Pricing is shown in the App and confirmed at checkout through Google Play, in your local currency where applicable.
  • Automatic renewal. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage or cancel your subscription at any time through your Google Play account settings.
  • Cancellation. If you cancel, you will retain access to HWTA Plus features until the end of your current paid billing period. We do not provide prorated refunds for the unused portion of a billing period, except where required by law or Google Play policy.
  • Free tier remains available. Core tracking, history, privacy tools (app lock, encrypted backup), and raw data export remain available at no cost, with or without an HWTA Plus subscription. Cancelling or letting your subscription lapse does not delete your existing data, photos, or previously generated files.
  • Refunds. Refund requests are subject to Google Play’s refund policies, as Google processes all payments.

7. Optional donations/tips

Any optional donation or “tip” you choose to provide is separate from an HWTA Plus subscription, is non-refundable except as required by law or applicable platform policy, and does not unlock any additional App functionality.

8. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or tamper with the App’s billing or entitlement systems
  • Use the App to store or transmit content that is unlawful, abusive, or that infringes on the rights of others

9. Intellectual property

The App, including its design, code, and branding, is owned by Ridge Road Apps LLC. You retain full ownership of the health data and photos you enter into the App.

10. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDGE ROAD APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON INFORMATION DISPLAYED BY THE APP.

Our total liability arising from these Terms or your use of the App shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

12. Changes to the App and these Terms

We may update, modify, or discontinue features of the App at any time. We may also update these Terms from time to time; if we make material changes, we will update the “Last updated” date above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Termination

You may stop using the App and uninstall it at any time. We reserve the right to suspend or discontinue the App or your access to it, including HWTA Plus features, if we reasonably believe these Terms have been violated.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles, unless otherwise required by the laws of your jurisdiction.
